General Terms and Conditions of Business for Hospitality Agreement
1. Application
All terms and conditions of use for the website www.room-pool.com are listed below and apply to all bookings and hospitality agreements for rooms, hotel rooms, apartments, flats and houses listed on the website (hereinafter referred to as „accommodation")
2. Parties
The hospitality agreement for accommodation is a direct and exclusive contract between the person booking (guest) and the hotelier/ owner of the accommodation. Room Pool by Service Station AG functions only as an intermediary agent between the two parties.
3. Contract conclusion and payment
A booking, and thereafter a hospitality agreement is only successfully concluded when the guest has chosen and confirmed the period of stay at the accommodation on the website www.room-pool.com, the payment has been completed and the guest has received an invoice per email, fax or letter.
All rooms offered on the website www.room-pool.com can only be booked via the website and not directly via the hotelier.
4. Prices / Methods of payment
All rates of accommodations are on the website www.room-pool.com. All prices are quoted as net prices in Swiss Francs, including VAT. Transactions are to be made to the following account:

We accept only money transfers through banks in Swiss Francs. Transfer charges are at the sender's expenses.
5. Cancellations
We charge 50% of the total amount of the total stay for booking cancellations.
For stays longer than 10 days we charge 30% of the total amount of the total stay for booking cancellations.
6. Arrival and departure times, contact details
The accommodation is available to the guest from 18.00 on the date of arrival till 10.00 on the date of departure. Should the guest require the accommodation outside of these hours (before 18.00 on date of arrival or after 10.00 on date of departure) this can be arranged in advance with the hotelier. Should the guest require the accommodation later than 10.00 on the date of departure, the guest will be charged full price for the accommodation for the day.
After choosing the accommodation the guest will receive the contact details of the hotelier (phone number and address). The guest then contacts the hotelier and coordinates time of arrival and handing over of accommodation keys with the hotelier.
7. Conditions for use of accommodation
The guest commits to following the house rules of the hotelier. Any violations of the house rules could result in the guest making him/herself liable for breach of contract and enabling the hotelier to cancel the contract immediately without reimbursement or repayment of outstanding money.

All information pertaining to furnishing and infrastructure of the accommodation can be found on the website www.room-pool.com
9. Guest Liability
The guest is liable to the full extent for all loss or damage caused to the property of the hotelier by the guest, his/her employees, helpers, or family members. It is the sole obligation of the guest to obtain a special insurance covering such risks.
10. Hotelier Liability
Should the hotelier not be in a position to offer the guest accommodation at all, the hotelier is liable for all damages and costs arising that are a direct result of the breach.
Should the hotelier for any other reason not be able to offer the guest the chosen accommodation, it lays within the liability of the hotelier to arrange equally suitable alternative accommodation as well as paying for any further costs which may have incurred as a result. For example added transport costs, difference in accommodation price etc. Should this be organised by the hotelier, the guest waives his right to further claims resulting from the breach.
Liability of the hotelier and all his assistants or representatives is limited to major negligence or unlawful intent. Minor negligence is not a ground for liability within the terms of this contract. The hotelier and his assistants or representatives are not liable for damage to the guest's cars. Should the guest suffer damage or not be satisfied with the level of service, the guest should report this at the first possible moment without delay. In the case of a delay the guest forfeits his/her rights and no further claims can be made. The hotelier accepts no liability for any damages suffered outside of the accommodation. This applies to all cases, including but not limited to cases of accident, injury, damage, theft or loss.
All claims against the hotelier expire 6 months after the date of departure, as far as no compulsory statutory limitation sees otherwise.
11. Privacy
Room Pool by Service Station AG may collect, process and use personal/private information as far as this is relevant to the booking process. In cases of disagreement Room Pool GmbH reserves the right to use the privileged stock data in order to maintain its position or alter its position as the case may be. Booking details and private information are processed and used according to Swiss legal regulations. Saving and exchanging of booking information is only done when necessary and if the guest is in agreement with the process. The guest agrees to provide Room Pool by Service Station AG with all relevant information about his/her particulars via email, fax or mail so that Room Pool by Service Station AG can have as comprehensive a list of particulars as possible.
12. Closing Conditions
Any changes or additions to the contract or receipt of reservation are only valid in the written form. Unilateral changes or additions are void and have no effect. By ticking the field „General Terms and Conditions" on the website www.room-pool.com the guest accepts all the terms and conditions set forth in the contract for the hospitality agreement.
In cases of conflicting language interpretation, the German language version takes priority.
The parties agree that in all matters or disputes for arbitration Swiss Law shall apply.
Court of jurisdiction is Zug/ Switzerland.
